What is a qualified certificate?

A certificate which complies with the regulations of the Act on Electronic Signature issued by a qualified entity providing certification services. An electronic signature verified by a qualified certificate and put with a secure e-signature device is equivalent to a handwritten signature. The regulations of the Act and secondary legislation include the level of equipment security, uniqueness of particular data and customer service methods.

A qualified certificate can be issued to a natural person only.

Application and advantages of the qualified certificate.

The qualified certificate can be used for:

  • submitting forms to KIO (National Chamber of Appeal)
  • submitting court pleadings in writ-of-payment proceedings, contacting ZUS (National Insurance Agency) by email and signing electronically such forms as an application for issuing a certificate on the absence of arrears in payments of social security contributions and social insurance statements.
  • giving legal validity to documentation (including electronic ZUS authorizations) used in legal relations over the Internet
  • obtaining electronic extracts relating to all businesses registered with the KRS (National Court Register).
  • signing official correspondence with the civil service bodies via an electronic inbox, submitting electronic tax returns
  • concluding civil-law contracts in an electronic form, issuing e-invoices, participating in electronic bids and tenders
  • communicating via ePUAP (Electronic Platform of Public Administration Services),
  • signing reports forwarded to GIIF (General Inspectorate of Fiscal Information)
  • submitting sets of personal details to GIODO (Inspector General for the Protection of Personal Data) by electronic means
  • submitting e-statements to UFG (Insurance Warranty Fund)
  • giving legal validity of official documents to electronic short copies and certificates issued by CIOZR (National Registered Pledge Information Retrieval System)
  • applying to PARP (Polish Agency for Enterprise Development) by electronic means for EU subsidies

Can one person apply for issuing several certificates relating to the same set of details?
Yes. One person can apply for issuing several certificates relating to the same set of details. However, you should remember that a qualified certificate can be used only by a natural person to whom it is assigned to. Pursuant to the Polish law (Art. 47 of the Act on Electronic Signature of 18 September 2001) the person who puts a secure e-signature using data for putting an electronic signature which was assigned to a different person is subject to a fine or imprisonment for up to three years or both.
